Publication or transmission of objectionable material

57. Publication or transmission of objectionable material



(1) A person must not use an on-line information service to publish or
transmit, or make available for transmission, objectionable material.

Penalty: 240 penalty units or imprisonment for 2 years.

(2) It is a defence to a prosecution for an offence against subsection (1) to
prove that the defendant believed on reasonable grounds that the material was
not objectionable material.

(3) Subsection (1) does not apply to a person who provides an on-line
information service or a telecommunication service unless the person creates
or knowingly downloads or copies objectionable material.
