False alarm of fire

20B. False alarm of fire



(1) If-

   (a)  a fire brigade in the country area of Victoria responds to a false
        alarm of fire given by an automatic fire alarm system; and

   (b)  the Authority, after considering a report by an officer of the
        Authority relating to the false alarm, determines that the owner or
        occupier of the property did not have a reasonable excuse for the
        alarm being given-

the Authority may by notice in writing given to the owner or occupier of the
property require the owner or occupier to pay to the Authority the fees and
charges prescribed for the attendance of the brigade in response to the false
alarm.

(2) A person whose interests are affected by a decision of the Authority under
subsection (1) may apply to the Victorian Civil and Administrative Tribunal,
within 28 days after receiving notice of the decision, for review of the
decision.

(3) This section does not apply in relation to an industry brigade.
