CHILD EMPLOYMENT ACT 2003 - SECT 53

Regulations

    (1)     The Governor in Council may make regulations for or with respect to—

        (a)     requiring employers to keep records in relation to the employment of children;

        (aa)     prescribing an activity or arrangement not to be employment;

S. 53(1)(ab) inserted by No. 26/2010 s. 34.

        (ab)     prescribing a person or class or classes of persons not to be employers;

S. 53(1)(ac) inserted by No. 26/2010 s. 34.

        (ac)     prescribing the periods for which employers must keep records in relation to the employment of children;

S. 53(1)(ad) inserted by No. 26/2010 s. 34, amended by No. 27/2022 s. 75(a).

        (ad)     providing for the imposition of fees for an application for a licence or renewal of a licence;

S. 53(1)(ae) inserted by No. 26/2010 s. 34.

        (ae)     prescribing a sporting activity to be a sporting activity with a high risk of injury;

S. 53(1)(af) inserted by No. 27/2022 s. 44(1).

        (af)     prescribing an infringement offence;

S. 53(1)(ag) inserted by No. 27/2022 s. 75(b).

        (ag)     prescribing information for the purposes of applications for licences, including information about the types or categories of work to be undertaken by children;

        (b)     prescribing any matter or thing required or permitted by this Act to be prescribed or necessary to be prescribed to give effect to this Act.

    (2)     The regulations—

        (a)     may be of general or limited application;

        (b)     may differ according to differences in time, place or circumstances;

        (c)     may impose a penalty for a contravention of the regulations not exceeding 20 penalty units;

S. 53(2)(d) inserted by No. 27/2022 s. 44(2).

        (d)     may impose an infringement penalty for a contravention of this Act not exceeding 12 penalty units for an individual or 24 penalty units for a body corporate;

S. 53(2)(e) inserted by No. 27/2022 s. 44(2).

        (e)     may impose an infringement penalty for a contravention of the regulations not exceeding 4 penalty units.
