CHILD EMPLOYMENT ACT 2003 - SECT 46

Confidentiality

S. 46(1) substituted by No. 27/2022 s. 37(1).

    (1)     An authorised officer must not, except to the extent necessary to exercise the authorised officer's powers under this Act, give to any other person, whether directly or indirectly, any information acquired by the authorised officer in exercising those powers.

Penalty:     60 penalty units.

    (2)     Subsection (1) does not apply to the giving of information—

        (a)     to a court or tribunal in the course of legal proceedings; or

        (b)     pursuant to an order of a court or tribunal; or

        (c)     to the extent reasonably required to enable the investigation or the enforcement of a law of Victoria or of any other State or Territory or of the Commonwealth; or

        (d)     with the written authority of the Wage Inspectorate Victoria; or

        (e)     to the Department; or

        (f)     to the Secretary; or

        (h)     to a person or body prescribed by the regulations; or

              (i)     with the written authority of the person to whom the information relates.
