Right to recover fees if there is non-compliance with this Part

37N. Right to recover fees if there is non-compliance with this Part

If a finance broker charges, receives, or accepts from a client, any amount as
a fee to which that finance broker is not entitled under this Part, or any
amount as a deposit on account of a fee for negotiating consumer credit, that
client may-

   (a)  recover that amount as a debt in a court of competent jurisdiction; or

   (b)  apply to the Tribunal for an order requiring the finance broker to
        repay that amount.
