Appeal to Commission

73. Appeal to Commission



(1) If a written order under section 72 prohibiting the person from entering
or remaining in a casino is made by-

   (a)  a single commissioner; or

   (b)  a casino operator; or

   (c)  a person for the time being in charge of a casino-

the person receiving the order may appeal against the order to the Commission
within 28 days of receipt of the written order.

(2) An appeal must-

   (a)  be in writing; and

   (b)  specify the grounds on which it is made.

(3) After consideration of an appeal, the Commission may, by order-

   (a)  reject the appeal and confirm the order; or

   (b)  allow the appeal (in whole or part) and substitute a new order or vary
        the order.

(4) An order of the Commission on an appeal-

   (a)  must be notified in writing to the person; and

   (b)  must include the reasons for its decision to make the order.

(5) Nothing in this section prejudices the right of the Commission, a casino
operator or a person in charge of a casino to make a further order in respect
of that person for a reason considered sufficient by the Commission, casino
operator or person in charge.

(6) An appeal against an order does not affect the operation of the decision
or prevent the taking of action to implement the order.

(7) In the case of an appeal against an order made by a single commissioner,
the Commission as constituted for the purposes of the appeal must not include
that commissioner.
