Determination of applications

44. Determination of applications



(1) The Commission must consider an application for a licence and must take
into account the investigation under section 43 and any submissions made by
the applicant within the time allowed and must make an assessment of-

   (a)  the integrity, responsibility, personal background and financial
        stability of the applicant; and

   (b)  the general reputation of the applicant having regard to character,
        honesty and integrity; and

   (c)  the suitability of the applicant to perform the type of work proposed
        to be performed by the applicant as a licensee.

(2) The Commission must determine the application by either issuing a licence
to the applicant or refusing the application and must inform the applicant
accordingly.

(3) The Commission is not required to give reasons for the decision but may
give reasons if it thinks fit.



(4) A function of the Commission under this section may be performed by any
commissioner.
