128C. Changes in Melbourne Casino area and site



(1) For the purposes of the Melbourne Casino project, the Governor in Council
may, by Order published in the Government Gazette-

   (a)  reduce the Melbourne Casino area, the Melbourne Casino site or the
        temporary casino site; or

   (b)  increase the Melbourne Casino area or the Melbourne Casino site or the
        temporary casino site by adding land in the vicinity of that area or
        site.

(2) The power under subsection (1) to reduce or increase the area of the
Melbourne Casino site may only be exercised if the boundaries of the casino
have not been defined under section 17.

(3) Land may only be added to the Melbourne Casino area, the Melbourne Casino
site or the temporary casino site under subsection (1) if the land is within
the permissible locations for a casino prescribed for the purposes of section
7.

(4) An Order under subsection (1) may revoke the approval of a plan and
approve a new or amended plan for the purposes of this Division.

(5) An Order under this section must be made on the Minister's recommendation
after the Minister has received any appropriate plans of survey signed by the
Surveyor-General.
