Commercial Arbitration Act 1984 - SECT 44

Removal of arbitrator or umpire

44. Removal of arbitrator or umpire

Where the Court is satisfied that-

   (a)  there has been misconduct on the part of an arbitrator or umpire or an
        arbitrator or umpire has misconducted the proceedings;

   (b)  undue influence has been exercised in relation to an arbitrator or
        umpire; or

   (c)  an arbitrator or umpire is incompetent or unsuitable to deal with the
        particular dispute-

the Court may, on the application of a party to the arbitration agreement,
remove the arbitrator or umpire.
