Name of conveyancing business

39. Name of conveyancing business



(1) This section applies if, in the opinion of the Authority, the name under
which a person operates, or proposes to operate, a conveyancing business-

   (a)  incorporates the name of an unlicensed person or any name which might
        be confused with the name already used by a licensee; or

   (b)  may mislead the public.





(2) The Authority-

   (a)  may refuse to issue the person with a licence until the person chooses
        a name that is acceptable to the Authority; or

   (b)  if the person already holds a licence, may require the person to
        change the name of the conveyancing business.

(3) A person must comply with any requirement made by the Authority under
subsection (2)(b) within the time specified by the Authority.

Penalty: 60 penalty units.
