Conveyancers Act 2006 - SECT 11

Eligibility for licence

11. Eligibility for licence



(1) A natural person, other than an Australian legal practitioner, is eligible
to obtain a licence if he or she-

   (a)  is at least 18 years of age; and

   (b)  has the competency qualifications and work experience referred to in
        section 12 for the issue of the licence; and

   (c)  is not a disqualified person; and

   (d)  either-

   (i)  is covered by the professional indemnity insurance required under
        section 41; or

   (ii) if the person is, or is to be, employed by a licensee, holds evidence
        of employment with, or an offer of employment from, the licensee and
        evidence that the person will be covered by the professional indemnity
        insurance required of the licensee under section 41; and

   (e)  has paid the prescribed application fee and the prescribed licence
        fee.

(2) A company, other than an incorporated legal practice, is eligible to
obtain a licence if-

   (a)  at least one of the directors of the company is a licensee; and

   (b)  no director of the company is a disqualified person; and

   (c)  the company holds the professional indemnity insurance required under
        section 41; and

   (d)  the company has paid the prescribed application fee and the prescribed
        licence fee.
