CONFISCATION ACT 1997 - SECT 78B
Certificate of responsibility and power(1) The Secretary may issue a certificate that states that the Secretary has responsibility for, and power in relation to, specified property by virtue of a specified memorandum of understanding entered into under section 78A.
(2) A certificate purporting to be signed by the Secretary and issued under this section—
(a) is admissible in evidence in any proceedings; and
(b) in the absence of evidence to the contrary, is conclusive evidence of the matters stated in it.
(3) A certificate under this section must be in
the prescribed form.
