Meaning of conviction

4. Meaning of conviction



(1) For the purposes of this Act, a person is deemed to have been convicted of
an offence if-

   (a)  the person has been convicted of the offence; or

   (b)  the person has been charged with the offence and the court hearing the
        charge finds the person guilty of the offence but does not record a
        conviction; or

   (c)  the offence was taken into account by a court under section 100 of the
        Sentencing Act 1991 in sentencing the person for another offence; or

   (d)  the person has been charged with the offence but, before the charge is
        finally determined, the person absconds.





(2) For the purposes of this Act, a person who, because of subsection (1), is
deemed to have been convicted of an offence, is deemed to have committed that
offence.
