31E. Application may be made by telephone etc.
(1) If it is impracticable for the applicant for a freezing order to apply in
person, the applicant may apply under section 31D for a freezing order by
telephone, facsimile or other form of communication.
(2) If transmission by facsimile machine is available and an affidavit has
been prepared, the applicant must transmit a copy of the affidavit, whether
sworn or unsworn, to the venue of the Magistrates' Court that is to determine
the application for a freezing order.
(3) If an application is made under section 31D in accordance with this
section, the applicant, not later than the day following the making of the
application, must send the original affidavit duly sworn to the venue of the
Magistrates' Court that determined the application, whether or not a freezing
order has been made.
