Application may be made by telephone or other electronic communication

    (1)     An investigative officer may apply under section 31D for a freezing order by telephone, facsimile or other form of electronic communication.

    (2)     If transmission by facsimile machine or other electronic communication is available and an affidavit has been prepared, the applicant must transmit a copy of the affidavit, even if the affidavit is not sworn or affirmed, to the venue of the Magistrates' Court that is to determine the application for a freezing order.

    (3)     If an application is made under section 31D in accordance with this section, the applicant, not later than the day following the making of the application, must send the original affidavit duly sworn or affirmed to the venue of the Magistrates' Court that determined the application, whether or not a freezing order has been made.
