8A. Commissioner





(1) The Secretary may under Part 3 of the Public Administration Act 2004
employ a person to be Commissioner for the purposes of this Act.





(2) The Commissioner is responsible for-

   (a)  assessing performance in the provision of all correctional services to
        achieve the safe custody and welfare of prisoners and offenders; and

   (b)  exercising any other functions relating to correctional services that
        the Secretary may determine from time to time.



(3) The Commissioner must endeavour to exercise his or her functions in
relation to correctional services impartially between all providers of
correctional services so far as this is consistent with the safe custody and
welfare of prisoners and offenders and the proper operation of the
correctional services.
