Delegation

8. Delegation







(1) The Secretary may, by instrument, delegate to the Commissioner or to any
other employee of the Department of Justice or to any officer within the
meaning of Part 5 or Part 9 any function, power, duty or responsibility of the
Secretary-

   (a)  under this Act or the regulations or under any other Act other than
        the Public Administration Act 2004; or





   (ab) under regulations made under any Act other than the
        Public Administration Act 2004; or





   (b)  under an agreement under Part 2A-

except this power of delegation and the Secretary's powers under section 54A.

(2) The Secretary may under subsection (1) delegate a function, power, duty or
responsibility to a person or class of persons.
