Credit contracts deemed to be regulated contracts

7. Credit contracts deemed to be regulated contracts

Where it is alleged in any proceeding under this Act or in any other
proceeding in respect of a matter arising under this Act that-

   (a)  a credit sale contract or a loan contract is a credit sale contract or
        loan contract to which Part III applies; or





   (b)  a continuing credit contract is a continuing credit contract to which
        Part III applies-

it shall be presumed, unless the contrary is established, that Part III
applies to the credit sale contract or loan contract or that Part III applies
to the continuing credit contract.
