Amendment of certain Acts

14. Amendment of certain Acts



(1) In section 4(1) of the Business Names Act 1962 for the interpretation of
Commissioner there shall be substituted the following interpretation-



"Commissioner means the Commissioner for Corporate Affairs under the Companies
(Administration) Act 1981.".

(2) The Companies Act 1961 is amended as follows-

   (a)  in section 5(1) for the interpretation of Commissioner there shall be
        substituted the following interpretation-







"Commissioner means the Commissioner for Corporate Affairs under the Companies
(Administration) Act 1981.";

   (b)  subsections (1), (1A), (2), (3), (4), (4A), (4B), (4C) and (5) of
        section 7 shall be repealed;

   (c)  sections 8 and 9 shall be repealed.

(3) In section 107A(1)(c) of the Magistrates (Summary Proceedings) Act 1975
for the expression "Commissioner for Corporate Affairs appointed pursuant to
the Companies Act 1961 or by the officer holding the corresponding office
under any corresponding Act or ordinance for the time being in force in any
State or Territory of the Commonwealth"
there shall be substituted the expression "Commissioner for Corporate Affairs
under the Companies (Administration) Act 1981 or by a person who, under a law
in force in another State or in a Territory, holds an office in that State or
Territory that corresponds to the office of the Commissioner for Corporate
Affairs under the Companies (Administration) Act 1981".

(4) In section 4(1) of the Securities Industry Act 1975 for the interpretation
of Commissioner there shall be substituted the following interpretation-



"Commissioner means the Commissioner for Corporate Affairs under the Companies
(Administration) Act 1981.".





(5) The Securities Industry (Application of Laws) Act 1981 is amended as
follows-

   (a)  in section 4(1) for the interpretation of
        Commissioner for Corporate Affairs there shall be substituted the
        following interpretation-



"Commissioner for Corporate Affairs means the Commissioner for Corporate
Affairs under the Companies (Administration) Act 1981."; and

   (b)  in section 24 after the word "Commissioner" (where four times
        occurring) there shall be inserted the words "for Corporate Affairs".

(6) In section 69(2) of the Evidence Act 1958-

(a) in paragraph (a), after the words "Corporate Affairs Commission of the
State of New South Wales" there shall be inserted the words "or South
Australia";

   (b)  in paragraph (a), for the words "or Western Australia" there shall be
        substituted the words "South Australia, Western Australia or
        Tasmania"; and

(c) in paragraph (b), for the expression "Companies Act 1961"
there shall be substituted the expression "Companies (Administration) Act
1981".
