CONSTITUTION ACT 1975 - SECT 78A
Chief Justice and Judges of Court of Appeal(1) A Judge may be appointed to be the Chief Justice, the President of the Court of Appeal or a Judge of Appeal either at the time of appointment as a Judge of the Court or, by further commission, at any later time.

(2) A reserve Judge must not be appointed as Chief Justice or President of the Court of Appeal.
