49. Public officers not to sit in Parliament except as mentioned

Except where express provision is made to the contrary by any Act or enactment
no person who holds any office or place of profit under the Crown (whether in
right of Victoria or any other capacity), or is in any manner employed in the
public service of Victoria or of the Commonwealth for salary wages fees or
emolument, shall sit or vote in the Council or the Assembly; and the election
of any such person to be a member of the Council or the Assembly shall be null
and void.
