47. Member of Victorian Parliament elected to Federal Parliament

If a member of the Council or the Assembly is elected a member of either House
of the Parliament of the Commonwealth his seat in the Council or the Assembly
shall become vacant-

   (a)  if a petition against the return of the member to the Parliament of
        the Commonwealth is not lodged within the time allowed for the lodging
        of such petitions, upon the expiration of the time so allowed; or

   (b)  if a petition is lodged within the time allowed for the lodging of
        such petitions, upon the final determination of that petition in
        favour of the member.
