Vacation of seat

46. Vacation of seat

If a member of the Council or the Assembly-

   (a)  ceases to be qualified to be elected a member of the Council or the
        Assembly; or

   (b)  fails to attend the Council or the Assembly without the permission of
        the Council or the Assembly (as the case may be) for one entire
        session-

his seat in the Council or the Assembly shall become vacant.
