CRIMES ACT 1958 - SECT 588
Transitional provisions (Crimes (Amendment) Act 1997—Part 3)(1) Section 398A applies to any trial, committal proceeding or hearing of a charge for an offence that commences on or after 1 January 1998, irrespective of when the offence to which the trial, committal proceeding or hearing relates is alleged to have been committed.
(2) For the purposes of subsection (1)—
(a) a trial commences on arraignment of the accused in accordance with Subdivision (12) of Division 1 of Part III; and
(b) a committal proceeding commences on the committal mention date; and
(c) a hearing of a charge for an offence commences on the taking of a formal plea from the accused.
