Hearing of application for exclusion of evidence
391B. Hearing of application for exclusion of evidence
If an accused person arraigned on an indictment or presentment before the
Supreme Court or the County Court seeks to satisfy the Court (whether before
or after the empanelling of a jury) that it should exclude evidence solely by
the exercise of a discretion, the Court may, in hearing and determining the
question, hear evidence called on behalf of the accused person before it hears
evidence called on behalf of the Crown.
