Confidentiality of reports

61. Confidentiality of reports





(1) A person who is or has been a person authorized or employed by the Council
to perform a function or discharge a duty with respect to reports submitted to
the Council pursuant to section 60 shall not, except to the extent necessary
to perform the function or discharge the duty, either directly or indirectly
make a record of or divulge or communicate to any person any information that
is gained by or conveyed to him by reason of the authorization or employment,
or make use of the information for any purpose other than the performance of
the function or the discharge of the duty.

Penalty: 10 penalty units.

(2) Nothing in subsection (1) precludes a person from-

   (a)  producing a document to a court in the course of criminal proceedings
        or in the course of any proceedings under this or any other Act; or

   (b)  divulging or communicating to a court in the course of any proceedings
        referred to in paragraph (a) any matter or thing coming to his
        knowledge in the performance of a function or the discharge of a duty
        referred to in subsection (1).
