Application

30. Application

This Division applies if-

   (a)  an adjudicator or a review adjudicator has determined that an
        adjudicated amount or part of an adjudicated amount is payable by a
        respondent to a claimant in respect of a construction contract; and

   (b)  the respondent fails to pay the whole or any part of the adjudicated
        amount to the claimant in accordance with section 28M or 28N; and

   (c)  the claimant has obtained judgment for the adjudicated amount or part
        of the adjudicated amount as a debt in a court of competent
        jurisdiction.
