Announcement before entry

37G. Announcement before entry



(1) On executing a search warrant, the inspector executing the warrant must
announce that he or she is authorised by the warrant to enter the place and,
if the inspector has been unable to obtain unforced entry, must give any
person at the place an opportunity to allow entry to the place.

(2) An inspector need not comply with subsection (1) if he or she believes on
reasonable grounds that immediate entry to the place is required to ensure the
safety of any person or that the effective execution of the search warrant is
not frustrated.
