No payments to certain persons or in respect of certain matters

35A. No payments to certain persons or in respect of certain matters



(1) Despite any other provision in this Act, no amount is to be paid by the
Board under this Act, other than on an application under section 6, 9 or 13-

   (a)  to a corporation having paid up share capital of $200 000 or more or
        to a subsidiary of such a corporation; or

   (b)  to an insurer of a party whose rights under the contract of insurance
        have been subrogated to the insurer; or

   (c)  in respect of costs that are recoverable under an insurance policy or
        would be recoverable but for any amount payable by way of excess under
        or in relation to the policy.

(2) In subsection (1), corporation and subsidiary have the same meanings as in
the Corporations Act.
