40. Jurisdiction under Workers Compensation Act 1958



(1) Subject to the County Court Act 1958, the County Court-

   (a)  has exclusive jurisdiction to inquire into, hear and determine12-

   (i)  any question or matter with respect to whether a claim for
        compensation should be made under the Workers Compensation Act 1958 or
        this Act; and

   (ii) any question or matter in relation to whether liability to pay
        compensation arises under the Workers Compensation Act 1958 or this
        Act; and

   (iii) any other question or matter relating to claims for compensation
        under the Workers Compensation Act 1958; and

   (b)  has jurisdiction to inquire into, hear and determine any question or
        matter relating to-



   (i)  whether an insurer is, or two or more insurers are, liable to
        indemnify an employer under a policy of insurance or indemnity issued
        under the Workers Compensation Act 1958; or

   (ii) the amount of any such liability; and

   (c)  has exclusive jurisdiction to inquire into, hear and determine any
        question or matter in respect of which jurisdiction is conferred on
        the County Court by this Act or the Workers Compensation Act 195813.
