Establishment of Authority

18. Establishment of Authority



(1) There is established by this Act an Authority by the name of the Victorian
WorkCover Authority.

(2) The Authority-

   (a)  is a body corporate with perpetual succession;

   (c)  may sue and be sued in its corporate name;

   (d)  shall, subject to this Act, be capable of taking, purchasing, leasing,
        holding, selling and disposing of real and personal property for the
        purpose of performing its functions and exercising its powers under
        this Act or any other Act;

   (e)  shall be capable of doing and suffering all such acts and things as
        bodies corporate may by law do and suffer and which are necessary or
        expedient for the purpose of performing its functions and exercising
        its powers under this Act or any other Act.

(3) A document is executed by the Authority if the document is signed by-

   (a)  2 Directors of the Board; or

   (b)  1 Director of the Board and the person who is designated by the Board
        to be the Secretary to the Board.

(4) A person may assume that a document has been duly executed by the
Authority if the document appears to have been signed in accordance with
subsection (3).

(5) All courts, judges and persons acting judicially must take judicial notice
of the signatures on a document which appears to have been signed in
accordance with subsection (3).
