Application of this Part to certain other countries

88. Application of this Part to certain other countries



(1) The Governor in Council on being satisfied that a grant of probate or of
letters of administration issued by a court of competent jurisdiction in a
country other than an Australasian State or the United Kingdom or that a grant
or order issued by such a court appointing a person executor of a will or
giving a person authority to administer the estate of a deceased person
corresponds to a grant of probate or of letters of administration issued by
the Supreme Court of Victoria, may by proclamation declare that country to be
a country to which this Part applies.

(2) The Governor in Council may from time to time by further proclamation
revoke or alter any proclamation made under this section.

(3) Every proclamation made under this section shall be published in the
Government Gazette and a copy thereof shall be laid before both Houses of
Parliament so soon as may be after it is made.





(4) This Part when declared by proclamation to apply to a country shall
subject to any exceptions and modifications specified in the proclamation
apply to probates and grants and orders appointing persons executors of wills
or giving persons authority to administer the estates of deceased persons
granted or made in that country whether before or after the commencement of
this Act.
