Effect of recognition of adoption under this Part
69F. Effect of recognition of adoption under this Part
(1) Subject to this section, if the adoption of a child is recognised under
section 69D or 69E, then, for the purposes of the laws of Victoria, the
adoption has the same effect as an adoption order under this Act4.
(2) If the laws of the Convention country where the adoption was granted do
not provide that the adoption of the child terminates the legal relationship
between the child and the individuals who were, immediately before the
adoption, the child's parents, section 53(1)(b) does not apply to the adoption
unless-
(a) an order is made under section 69H or under a law of the Commonwealth
or of another State or a Territory that corresponds to section 69H; or
(b) a decision is made in a Convention country to convert the adoption in
accordance with article 27 of the Convention.
(3) Subsection (2)(b) does not apply if a declaration is made under section
69I(2)(b) or under a law of the Commonwealth or of another State or a
Territory that corresponds to section 69I(2)(b).
