Recognition of adoption of a child from a Convention country to Australia

69D. Recognition of adoption of a child from a Convention country to Australia



(1) Subject to this section, an adoption in a Convention country-

   (a)  of a child who is habitually resident in a Convention country; and

   (b)  by a person who is habitually resident in Australia-

is recognised if an adoption compliance certificate issued in that country is
in force for the adoption.

(2) An adoption recognised under subsection (1) is effective on and from the
day the adoption compliance certificate becomes effective.

(3) Subsection (1) does not apply if-

   (a)  a declaration is made under section 69I(2)(a); or

   (b)  a declaration is made under a law of the Commonwealth or of another
        State or a Territory that corresponds to section 69I(2)(a).
