Personal or private records may be withheld

9. Personal or private records may be withheld



(1) Where the Minister is of opinion that any records required by this Act to
be transferred from a public office to the Public Record Office contain
matters of such a private or personal nature that they should not be open for
public inspection he may, after consultation with the Minister responsible for
the administration of the public office concerned, declare those records to be
private or personal records and not available for public inspection for a
period specified in the declaration.

(2) The Minister, after consultation with the Minister responsible for the
administration of the public office from which any such private or personal
records were transferred, or if the case so requires, of the public office at
the time exercising the functions to which the records relate, may-

   (a)  revoke or vary any declaration under subsection (1) in respect of
        those records; or

   (b)  permit, on any conditions or restrictions specified, all or any of
        those records to be open for inspection by any specified person or
        class of persons.
