Conciliation process

33. Conciliation process



(1) If the Privacy Commissioner considers it reasonably possible that a
complaint may be conciliated successfully, he or she must make all reasonable
endeavours to conciliate the complaint.

(2) Subsection (1) does not apply to a complaint-

   (a)  that the Privacy Commissioner has declined to entertain under section
        29 or dismissed under section 30; or

   (b)  that the Minister has referred to the Tribunal under section 31.

(3) The Privacy Commissioner may require a party to attend a conciliation
either personally or by a representative who has authority to settle the
matter on behalf of the party.
