PARLIAMENT OF VICTORIA A BILL to provide for the transfer to the State of the property, rights and liabilities of Melbourne Parks and Waterways, to repeal certain provisions of the Water Industry Act 1994 establishing Melbourne Parks and Waterways, to make further amendments to the Water Act 1989, the Water Industry Act 1994 and other Acts, to provide for the repeal of the Wattle Park Land Act 1991 and for other purposes. Water Industry (Amendment) Act 1999 The Parliament of Victoria enacts as follows: PART 1--PRELIMINARY 1. Purpose The purpose of this Act is-- 1 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 s. 2 Act No. (a) to provide for the transfer to the State of the property, rights and liabilities of Melbourne Parks and Waterways; and (b) to repeal certain provisions of the Water 5 Industry Act 1994 establishing Melbourne Parks and Waterways; and (c) to make further amendments to the Water Act 1989, the Water Industry Act 1994 and other Acts and to provide for the repeal of 10 the Wattle Park Land Act 1991. 2. Commencement (1) This Part comes into operation on the day on which this Act receives the Royal Assent. (2) Sections 40(1) and 46 are deemed to have come 15 into operation on the day on which section 5 of the National Parks (Amendment) Act 1998 came into operation. (3) Section 49 is deemed to have come into operation on the day on which section 12 of the Water Acts 20 (Amendment) Act 1999 came into operation. (4) Subject to sub-section (5), the remaining provisions of this Act come into operation on a day or days to be proclaimed. (5) If a provision referred to in sub-section (4) does 25 not come into operation before 1 July 2000, it comes into operation on that day. _______________ 2 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 s. 3 Act No. PART 2--AMENDMENTS TO THE WATER INDUSTRY ACT 1994 No. 121/1994. 3. Principal Act Reprint No. 3 In this Part, the Water Industry Act 1994 is as at 1 January 5 called the Principal Act. 1999. 4. Amendment of definitions (1) In section 3(1) of the Principal Act-- (a) insert the following definitions-- ' "authorised officer" means a person 10 appointed as an authorised officer under Part 9 of the Conservation, Forests and Lands Act 1987 for the purposes of Division 4 or 6 of Part 4 of this Act; 15 "waterways land" means land of the Crown which is comprised of-- (a) the bed, soil and banks of-- (i) all rivers, creeks, watercourses and other 20 waterways within the metropolis, within the meaning of the MMBW Act; and (ii) any length of the Werribee 25 River which is declared to be waterways land by Order of the Governor in Council under sub-section (1A); and (b) any land which is within 20 30 metres of land described in paragraph (a);'; 3 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 s. 5 8 Act No. (b) in the definition of "authorised person" omit "or Melbourne Parks and Waterways, as the case requires,"; (c) for the definition of "rating authority" 5 substitute-- ' "rating authority" means the Minister administering Part 4;'. (2) In section 3 of the Principal Act, after sub-section (1) insert-- 10 "(1A) The Governor in Council may, by Order made on the recommendation of the Minister administering Part 4 and published in the Government Gazette, declare the bed, soil and banks of any length of the Werribee 15 River to be waterways land.". 5. Price regulation In section 8(1) of the Principal Act, for ", Melbourne Water Corporation and Melbourne Parks and Waterways" substitute "and Melbourne 20 Water Corporation". 6. Application of payments made to licensee (1) In section 33(1)(b) of the Principal Act, for "Melbourne Parks and Waterways" (wherever occurring) substitute "the rating authority". 25 (2) In section 33(2) of the Principal Act, for "Melbourne Parks and Waterways" substitute "the rating authority". 7. Information statements In section 75(3)(c) of the Principal Act, for 30 "Melbourne Parks and Waterways" substitute "the rating authority". 8. Amendment of heading to Part 4 4 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 Act No. In the heading to Part 4 of the Principal Act, for "MELBOURNE PARKS AND WATERWAYS" substitute "RATING POWERS AND POWERS OVER 5 WATERWAYS LAND". 9. Repeal of provisions establishing Melbourne Parks and Waterways Divisions 1, 2 and 3 of Part 4 of the Principal Act are repealed. 10 10. Repeal of land acquisition and management provisions Sections 132, 133, 134 and 135 of the Principal Act are repealed. 11. Jetty and mooring licences 15 (1) In section 135A of the Principal Act, for sub- sections (1), (2) and (3) substitute-- "(1) Despite anything to the contrary in the Land Act 1958 or any other Act, the Minister may grant, to an applicant, a licence in respect of 20 any waterways land for the purposes of a jetty or mooring.". (2) In section 135A(5) and (6) of the Principal Act, for "Melbourne Parks and Waterways" (wherever occurring) substitute "the Minister". 25 (3) In section 135A(7) of the Principal Act-- (a) for "Melbourne Parks and Waterways" substitute "the Minister"; and (b) in paragraphs (a) and (b) omit "or vessel"; and 30 (c) for "it" substitute "he or she". (4) In section 135A of the Principal Act, sub-sections (9), (10) and (11) are repealed. 5 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 s. 12 Act No. 12. Repeal of leasing power Section 135B of the Principal Act is repealed. 13. Substitution of sections 136, 137 and 138 For sections 136, 137 and 138 of the Principal Act 5 substitute-- '136. Management of reservoir parks land (1) The Governor in Council may, on the recommendation of the Minister, make regulations for or with respect to any of the 10 matters referred to in section 13(1)(b)(ii) to (xi) of the Crown Land (Reserves) Act 1978 in relation to any reservoir parks land as if-- (a) any reference in that section to a 15 committee of management were a reference to the Minister; and (b) any reference in that section to the land were a reference to reservoir parks land. 20 (2) Section 13(5), (6), (7) and (8) of the Crown Land (Reserves) Act 1978 applies to regulations made under sub-section (1) as if-- (a) the regulations had been made under 25 section 13(1) of that Act; and (b) any reference to-- (i) an authorised officer in that section; or (ii) an officer or servant employed by 30 the committee of management or the trustees of any land-- 6 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 s. 14 16 Act No. were a reference to an authorised officer. (3) Regulations under this section do not have effect unless there is in force a lease and 5 licence of the reservoir parks land which is or is to the effect of the lease and licence referred to in section 137. (4) In this section-- "reservoir parks land" means the land 10 which is the subject of the lease and licence referred to in section 137. 137. Transfer of lease and licence of reservoir parks to the State On the commencement of section 9 of the 15 Water Industry (Amendment) Act 1999, in relation to the lease and licence of the land generally described as reservoir parks dated 13 April 1995, between Melbourne Water Corporation and Melbourne Parks and 20 Waterways, the Minister is substituted for Melbourne Parks and Waterways as the lessee and licensee under the lease and licence.'. 14. Amendment of power to make rates 25 In section 139 of the Principal Act, sub-section (1) is repealed. 15. Repeal of provisions relating to service charges Sections 144 and 145 of the Principal Act are repealed. 30 16. Substitution of sections 147 and 148 For sections 147 and 148 of the Principal Act substitute-- 7 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 Act No. "147. Powers of authorised officers (1) For the purposes of enforcing Division 4 and this Division, each authorised officer has the same powers as an authorised officer has 5 under section 31 of the Land Act 1958. (2) Sub-section (1) has effect as if any reference in section 31 of the Land Act 1958 to regulations made under the Land Act 1958 or section 13 of the Crown Land (Reserves) 10 Act 1978 were a reference to regulations made under Division 4 or this Division. 148. Power of Secretary to enter into management agreements Despite anything to the contrary in the Land 15 Act 1958, the Secretary may enter into a management agreement with any person with respect to the whole or any part of any waterways land (which is not land under the National Parks Act 1975 or Crown land 20 permanently or temporarily reserved under the Crown Land (Reserves) Act 1978) to manage the land for the purposes of recreation, leisure, tourism or transport.". 17. Amendment of regulation making power 25 (1) In section 149 of the Principal Act-- (a) in paragraph (a), for "good order in, any open space or park under the management and control of Melbourne Parks and Waterways" substitute "good order on, any 30 waterways land"; (b) for paragraph (b) substitute-- "(b) the removal from any waterways land of any structure, vehicle, abandoned or 8 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 s. 18 19 Act No. derelict vessel or other thing, and the manner in which the thing removed may be dealt with or disposed of;"; (c) after paragraph (b) insert-- 5 "(c) prohibiting or regulating activities relating to recreation, leisure, tourism or transport on waterways land; (d) fees or charges for-- (i) entry on the whole or any part of 10 waterways land (including any waters on that land) by any person or animal; or (ii) the provision or use of any improvements, services or 15 facilities on any waterways land; (e) closing any part of waterways land-- (i) for the purposes of an organised activity; or (ii) in an emergency or for the 20 purposes of public safety or safe navigation of waters on that land; (f) navigation on any waters on waterways land.". 18. Consequential repeal 25 Division 7 of Part 4 of the Principal Act is repealed. 19. Parks and Reserves Trust Account (1) In section 153A(2) of the Principal Act-- 9 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 Act No. (a) in paragraph (a) omit "Melbourne Parks and Waterways or"; (b) paragraph (b) is repealed. (2) In section 153A(3) of the Principal Act-- 5 (a) in paragraph (c) omit "Melbourne Parks and Waterways or"; (b) paragraph (d) is repealed. (3) In section 153A of the Principal Act, for sub- section (5) substitute-- 10 '(5) In this section-- "metropolitan area" means the area or areas specified by the Governor in Council for the purposes of this section by Order published in the Government 15 Gazette.'. 20. Responsibility for the management of waterways in the metropolitan area In section 175A(3) of the Principal Act, for "any Order in Council made under section 110(1)(a) or 20 (b) of this Act" substitute "Part 4". 21. Power of Minister to delegate In section 176 of the Principal Act, omit "or Melbourne Parks and Waterways". 22. Insertion of new Parts 7 and 8 25 After Part 6 of the Principal Act insert-- 'PART 7--TRANSITIONAL PROVISIONS 10 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 s. 22 Act No. 186. Transitional provision for Melbourne Parks and Waterways Except as otherwise provided in this Act, on the commencement of section 9 of the 5 Water Industry (Amendment) Act 1999-- (a) Melbourne Parks and Waterways is abolished and the members of its Board of directors go out of office; and (b) all rights, property and assets that, 10 immediately before that commencement were vested in Melbourne Parks and Waterways, vest in the State; and (c) all debts, liabilities and obligations of 15 Melbourne Parks and Waterways existing immediately before that commencement, become debts, liabilities and obligations of the State; and 20 (d) the State is substituted as a party to any proceedings pending in any court or tribunal to which Melbourne Parks and Waterways was a party immediately before that commencement; and 25 (e) the State is substituted as a party to any arrangement or contract entered into by or on behalf of Melbourne Parks and Waterways and in force immediately before that commencement; and 30 (f) any reference to Melbourne Parks and Waterways in any Act or in any proclamation, Order in Council, rule, regulation, order, agreement, instrument, deed or other document, so 35 far as it relates to any period after that 11 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 s. 22 Act No. commencement, and if not inconsistent with the context or subject matter, must be construed as a reference to the State. 187. Continued operation of jetty and mooring 5 licences Despite the commencement of section 11 of the Water Industry (Amendment) Act 1999, any licence issued under section 135A of this Act, and in force immediately before 10 that commencement, continues in force on and from that commencement and section 135A, as in force immediately before that commencement, continues to apply to any such licence until the licence expires or is 15 cancelled (whichever is the earlier). PART 8--SURRENDER AND RESERVATION OF MPW LAND Division 1--Preliminary 188. Definition 20 In this Part-- "Central Plan Office" means the Central Plan Office of the Department of Natural Resources and Environment. Division 2--General surrender and reservation 25 of land 189. Surrender and reservation of land at Braeside Park and the Spring Park Golf Course (1) The Minister-- 30 (a) on receiving a plan signed by the Surveyor-General of the land shown 12 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 s. 22 Act No. coloured green on the plan numbered LEGL./99-48 and lodged in the Central Plan Office; and (b) on being satisfied that the land shown 5 in the plan signed by the Surveyor- General corresponds as nearly as practicable with the land shown coloured green on the plan lodged in the Central Plan Office-- 10 may recommend to the Governor in Council that the land shown in the plan signed by the Surveyor-General be surrendered to the Crown. (2) On receiving the Minister's recommendation, 15 the Governor in Council may, by Order published in the Government Gazette, declare-- (a) that any interest in the land shown in the plan signed by the Surveyor- 20 General that is vested in another person is divested from that person; and (b) that the land is surrendered to the Crown. (3) On publication of an Order under sub-section 25 (2) in the Government Gazette-- (a) the land shown in the plan signed by the Surveyor-General is deemed to be unalienated land of the Crown, freed and discharged from all trusts, 30 limitations, reservations, restrictions, encumbrances, estates and interests; and (b) if any part of the land is or is being used as a road, that part of the land 35 ceases to be a road and all rights, 13 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 s. 22 Act No. easements and privileges existing or claimed in it, either in the public or by any body or person as incident to any express or implied grant, or past 5 dedication or supposed dedication or by user or operation of law or otherwise, cease; and (c) the folios of the Register set out in Part 1 of Schedule 3 are cancelled; and 10 (d) the land is deemed to be permanently reserved under section 4(1) of the Crown Land (Reserves) Act 1978 for public purposes, being in particular the purposes of recreation, leisure, tourism 15 and conservation and the reservation may be dealt with in accordance with that Act. 190. Surrender and reservation of land at Cardinia Creek Park 20 (1) The Minister-- (a) on receiving a plan signed by the Surveyor-General of the land shown coloured green on the plan numbered LEGL./99-49 and lodged in the Central 25 Plan Office; and (b) on being satisfied that the land shown in the plan signed by the Surveyor- General corresponds as nearly as practicable with the land shown 30 coloured green on the plan lodged in the Central Plan Office-- may recommend to the Governor in Council that the land shown in the plan signed by the Surveyor-General be surrendered to the 35 Crown. 14 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 s. 22 Act No. (2) On receiving the Minister's recommendation, the Governor in Council may, by Order published in the Government Gazette, declare-- 5 (a) that any interest in the land shown in the plan signed by the Surveyor- General that is vested in another person is divested from that person; and (b) that the land is surrendered to the 10 Crown. (3) On publication of an Order under sub-section (2) in the Government Gazette-- (a) the land shown in the plan signed by the Surveyor-General is deemed to be 15 unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests; and 20 (b) if any part of the land is or is being used as a road, that part of the land ceases to be a road and all rights, easements and privileges existing or claimed in it, either in the public or by 25 any body or person as incident to any express or implied grant, or past dedication or supposed dedication or by user or operation of law or otherwise, cease; and 30 (c) the folios of the Register set out in Part 2 of Schedule 3 are cancelled; and (d) the land is deemed to be permanently reserved under section 4(1) of the Crown Land (Reserves) Act 1978 for 35 public purposes, being in particular the 15 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 s. 22 Act No. purposes of recreation, leisure, tourism and conservation and the reservation may be dealt with in accordance with that Act. 5 191. Surrender and reservation of land at the Dandenong Valley Parklands (1) The Minister-- (a) on receiving a plan signed by the Surveyor-General-- 10 (i) of the land shown coloured green and shown hatched red on the plan numbered LEGL./99-50 and lodged in the Central Plan Office; and 15 (ii) showing by hatching the land shown coloured green on the plan numbered LEGL./99-50; and (b) on being satisfied that the land shown in the plan signed by the Surveyor- 20 General corresponds as nearly as practicable with the land shown coloured green and shown hatched red on the plan lodged in the Central Plan Office-- 25 may recommend to the Governor in Council that the land shown in the plan signed by the Surveyor-General be surrendered to the Crown. (2) On receiving the Minister's recommendation, 30 the Governor in Council may, by Order published in the Government Gazette, declare-- (a) that any interest in the land shown in the plan signed by the Surveyor- 16 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 s. 22 Act No. General that is vested in another person is divested from that person; and (b) that the land is surrendered to the Crown. 5 (3) On publication of an Order under sub-section (2) in the Government Gazette-- (a) the land shown in the plan signed by the Surveyor-General is deemed to be unalienated land of the Crown, freed 10 and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests; and (b) if any part of the land is or is being 15 used as a road, that part of the land ceases to be a road and all rights, easements and privileges existing or claimed in it, either in the public or by any body or person as incident to any 20 express or implied grant, or past dedication or supposed dedication or by user or operation of law or otherwise, cease; and (c) the folios of the Register set out in 25 Part 3 of Schedule 3 are cancelled; and (d) the land shown hatched in the plan signed by the Surveyor-General is deemed to be permanently reserved under section 4(1) of the Crown Land 30 (Reserves) Act 1978 for public purposes, being in particular the purposes of recreation, leisure, tourism and conservation and the reservation may be dealt with in accordance with 35 that Act. 17 532201B.I1-25/5/99

 


 

Water Industry (Amendment) Act 1999 s. 22 Act No. 192. Surrender and reservation of land at the Lower Maribyrnong Parklands (1) The Minister-- (a) on receiving a plan signed by the 5 Surveyor-General of the land shown coloured green on the plan numbered LEGL./99-51 and lodged in the Central Plan Office; and (b) on being satisfied that the land shown 10 in the plan signed by the Surveyor- General corresponds as nearly as practicable with the land shown coloured green on the plan lodged in the Central Plan Office-- 15 may recommend to the Governor in Council that the land shown in the plan signed by the Surveyor-General be surrendered to the Crown. (2) On receiving the Minister's recommendation, 20 the Governor in Council may, by Order published in the Government Gazette, declare-- (a) that any interest in the land shown in the plan signed by the Surveyor- 25 General that is vested in another person is divested from that person; and (b) that the land is surrendered to the Crown. Water Industry (Amendment) Act 1999 s. 22 Act No. (5) Nothing effected by this section is to be regarded as placing any person in breach of or as constituting a default under any provision of a lease, including any provision 5 prohibiting, restricting or regulating the assignment of a lease. 202. Action by Registrar of Titles On being requested to do so and on delivery of any relevant instrument or document (but 10 without production of a duplicate Crown grant or certificate of title), the Registrar of Titles must make any recordings in the Register that are necessary because of the operation of this Division and Division 3. 15 Division 3--Wattle Park Land 203. Repeal of the Wattle Park Land Act 1991 The Wattle Park Land Act 1991 is repealed. 204. Saving of rights 10 (1) This Division does not affect the status or continuity of any interest in, licence or right affecting or arrangement or agreement relating to-- (a) the Wattle Park Chalet; or 15 (b) any golf course or tennis court-- on the land set out in Schedule 5. (2) On the coming into operation of this Division, any lease, licence, agreement or arrangement to which sub-section (1) applies 20 to which Melbourne Parks and Waterways was a party has effect as if the Minister were substituted for Melbourne Parks and Waterways as that party. (3) Nothing effected by this section is to be 25 regarded as placing any person in breach of or as constituting a default under any provision of a lease, including any provision prohibiting, restricting or regulating the assignment of a lease.'. 30 23. Water Industry (Amendment) Act 1999 s. 24 Act No. PART 3--AMENDMENTS TO THE WATER ACT 1989 No. 80/1989. 24. Principal Act Reprint No. 4 In this Part, the Water Act 1989 is called the as at 1 October Principal Act. 1998. Further amended by Nos 76/1998, 85/1998 and 52/1998 (as amended by No. 101/1998). 5 25. Application of Part 10 In section 185(1) of the Principal Act, paragraph (c) is repealed. 26. Principal Act Further In this Part, the Parks Victoria Act 1998 is called amended by No. 76/1998. 5 the Principal Act. 34. Repeal of definition In section 3 of the Principal Act, for the definition of "MPW" substitute-- ' "MPW" means Melbourne Parks and 10 Waterways established under the Water Industry Act 1994 as in force before the coming into operation of section 9 of the Water Industry (Amendment) Act 1999;'. 35. Water Industry (Amendment) Act 1999 s. 36 Act No. PART 5--AMENDMENTS TO THE CROWN LAND (RESERVES) ACT 1978 No. 9212. 36. Principal Act Reprinted as In this Part, the Crown Land (Reserves) Act at 26 February 1998. Further 5 1978 is called the Principal Act. amended by Nos 46/1998, 76/1998 and 85/1998. 37. Power to acquire land under the Crown Land (Reserves) Act 1978 In section 5(4) of the Principal Act, after paragraph (b) insert-- 10 "(c) any land, which is within the area or areas specified for the purposes of section 139(1A) of the Water Industry Act 1994 by the Governor in Council by Order published in the Government Gazette, and which the 15 Minister is satisfied, on reasonable grounds, should be reserved for any of the purposes specified in paragraphs (w) and (x) of section 4(1).". 38. Power of Parks Victoria to act as a committee of 20 management In section 14(4) of the Principal Act, for paragraph (cb) substitute-- "(cb) Parks Victoria;". 39. Repeal of references to Melbourne Parks and Waterways and the Director of National Parks (1) In section 18(1) of the Principal Act, for ", Melbourne Parks and Waterways or, the 5 Director of National Parks and Wildlife" substitute "or Melbourne Parks and Waterways". (2) In section 18(1) of the Principal Act, for ", Melbourne Water Corporation, or Melbourne Parks and Waterways" substitute "or Melbourne 10 Water Corporation". (3) In section 18(3) of the Principal Act-- (a) in paragraph (c), for ", Melbourne Water Corporation or Melbourne Parks and Waterways" substitute "or Melbourne Water 15 Corporation"; (b) paragraph (d) is repealed. 41. Insertion of new section 18B After section 18A of the Principal Act insert-- "18B.
