PARLIAMENT OF VICTORIA
Initiated in Council 19 March 2003
A BILL
to amend the Vocational Education and Training Act 1990 and the
Victorian Qualifications Authority Act 2000 and for other purposes.
Vocational Education and Training
(TAFE Qualifications) Act 2003
The Parliament of Victoria enacts as follows:
1. Purposes
The main purposes of this Act are to amend--
(a) the Vocational Education and Training
Act 1990 to enable TAFE Colleges to
5 conduct courses in higher education and
issue higher education awards; and
(b) the Victorian Qualifications Authority Act
2000 to make further provision for
delegations to registered providers.

2. Commencement
This Act comes into operation on 30 June 2003.
3. Ministerial directions--higher education
See:
After section 6(1) of the Vocational Education Act No.
5 and Training Act 1990 insert-- 45/1990.

"(1A) The Minister may give written directions to as at
10 May 2001
the council of a TAFE College relating to-- and
amending
(a) offering and conducting courses of Act Nos
study leading to the conferral of higher 44/2001 and
11/2002.
10 education awards within the meaning of LawToday:
the Tertiary Education Act 1993; or www.dms.
dpc.vic.
gov.au
(b) the conferral of those higher education
awards.".
4. TAFE Colleges--higher education
15 After section 25(1)(ba) of the Vocational
Education and Training Act 1990 insert--
"(bb) to offer and conduct a course of study
leading to the conferral of a higher education
award within the meaning of the Tertiary
20 Education Act 1993 in accordance with that
Act; and
(bc) to confer a higher education award within the
meaning of the Tertiary Education Act
1993 in accordance with that Act; and".
25 5. Victorian Qualifications Authority--delegations

Qualifications Authority Act 2000 insert-- 97/2000
and
"(3) The Authority may, by instrument under its amending

Act No.
(a) a vocational education and training
course or a sequence of vocational
education and training;
(b) a further education course, other than a
5 further education course leading to the
issue of a higher education award
within the meaning of the Tertiary
Education Act 1993;
(c) any part of a course referred to in
10 paragraph (a) or (b)--
that the registered education and training
organisation provides or proposes to provide
to determine whether it should be registered
as accredited or continue to be registered as
15 accredited.".
6. Statute law revision
(1) In section 3 of the Victorian Qualifications
Authority Act 2000, in the definition of
"Department" omit ", Employment".
20 (2) In section 86 of the Vocational Education and
Training Act 1990, for the definition of "TAFE
provider" substitute--
' "TAFE provider" means a body registered
under section 23 of the Victorian
25 Qualifications Authority Act 2000.'.
