A BILL
to amend the Trade Measurement (Administration) Act 1995 and
for other purposes.
Trade Measurement (Administration)
(Amendment) Act 1998
The Parliament of Victoria enacts as follows:
1. Purpose
The purpose of this Act is to amend the Trade
Measurement (Administration) Act 1995 to
clarify the offences which may be prescribed by
5 regulations for the purpose of enabling
infringement notices to be served.

2. Power to serve infringement notice
In section 18(1) of the Trade Measurement
(Administration) Act 1995 after "Trade
Measurement Act 1995" insert "or against any
5 regulation made under the Trade Measurement
Act 1995 or the Trade Measurement
(Administration) Act 1995".
3. Validation provision
For section 28 of the Trade Measurement
10 (Administration) Act 1995 substitute--
"28. Validation of regulations and actions
(1) The Trade Measurement Regulations 1995,
Statutory Rule No. 194/1995, are deemed to
be as valid as if the Regulations had been
15 made under the Trade Measurement Act
1995 and the Trade Measurement
(Administration) Act 1995 as amended by
the Trade Measurement (Administration)
(Amendment) Act 1998.
20 (2) Without limiting the generality of sub-
section (1), anything done or purported to be
done under the Trade Measurement
Regulations 1995 before the commencement
of the Trade Measurement
25 (Administration) (Amendment) Act 1998
that would have been validly done had that
Act been in operation at the time at which
the thing was done or purported to have been
done, has and is deemed always to have had,
30 the same force and effect as it would have
had if that Act had been in operation at the
time at which the thing was done or
purported to have been done.".
