PARLIAMENT OF VICTORIA
A BILL
to repeal various redundant Acts, to repeal redundant provisions from
the Gas Industry (Residual Provisions) Act 1994 and to make
consequential amendments to that Act and other Acts and for other
purposes.
Treasury Legislation (Repeal) Act 2005
The Parliament of Victoria enacts as follows:
1. Purposes
The purposes of this Act are--
(a) to repeal a number of redundant Acts; and
(b) to repeal redundant provisions from the Gas
Industry (Residual Provisions) Act 1994;

and
(c) to make consequential amendments to that
Act and other Acts.

Act No.
2. Commencement
This Act comes into operation on the day after the
day on which it receives the Royal Assent.
3. Repeal of spent Acts
The Acts listed in Schedule 1 (to the extent that

they are not already repealed) are repealed.
4. Amendment of other Acts
The Act specified in the heading to each item in
Schedule 2 is amended as set out in that item.
5. Saving of references

(1) If a provision of an Act that is repealed by this Act
required a reference in an Act, subordinate
instrument or other instrument or document to a
person or body to be construed as a reference to
another person or body, the repeal of that

provision does not affect the construction of that
reference in that Act, instrument or document,
unless the contrary intention appears.
(2) This section does not affect or take away from the
Interpretation of Legislation Act 1984.

AMENDMENT OF ACTS
1. Accident Compensation Act 1985
5 At the end of Part IX insert--
"Division 6--Treasury Legislation (Repeal) Act 2005
286. Saving of rights under Miners' Phthisis (Treasury
Allowances) Act 1938
Despite the repeal of the Miners' Phthisis (Treasury
10 Allowances) Act 1938 by the Treasury Legislation
(Repeal) Act 2005, that 1938 Act continues to apply
to any person who was in receipt of an allowance
under that 1938 Act immediately before its repeal.".
2. Financial Management Act 1994
15 After section 63 insert--
"64. Saving of payments under Mint Act 1958
Despite the repeal of the Mint Act 1958 by the
Treasury Legislation (Repeal) Act 2005, any
obligation under that 1958 Act to pay an amount to
20 Her Majesty in England continues to apply as if that
1958 Act had not been repealed.".
3. Gas Industry (Residual Provisions) Act 1994
3.1. In section 3, the definitions of "apparatus and works",
"board" and "gaseous fuel" are repealed.
25 3.2 Sections 6 and 6A are repealed.
3.3 Division 3 of Part 2 is repealed.
3.4 Part 4 is repealed.
3.5 Part 5 is repealed.
3.6 Sections 62A, 62B, 62C, 62D and 62E are repealed.
30 3.7 Divisions 2, 3, 4 and 6 of Part 7 are repealed.
3.8 Sections 72, 73, 74, 75, 76, 77 and 78 are repealed.
3.9 Part 8 is repealed.

3.10 Part 8A is repealed.
3.11 Sections 88A, 88B, 88C, 90, 93, 94, 96, 96A, 97, 101,
101B(1) and 101B(3) are repealed.
3.12 Sections 103, 104, 104A, 104B and 104C are repealed.
5 3.13 Part 13 is repealed.
3.14 Sections 115B, 115C, 115E, 115F, 115G, 115H, 115I and
115J are repealed.
3.15 Division 4 of Part 13A is repealed.
3.16 Section 115R is repealed.
10 3.17 Schedule 3 is repealed.
4. Housing Act 1983
After section 144 insert--
"145. Saving of housing finance provisions
Despite the repeal of the Treasury Corporation of
15 Victoria (Housing Finance) Act 1995 by the
Treasury Legislation (Repeal) Act 2005, sections
11, 12, 13 and 15 of that 1995 Act continue to apply
as if that 1995 Act had not been repealed.".
5. Victorian Managed Insurance Authority Act 1996
20 5.1 After section 25B insert--
"25C. Authority is approved insurer
The Authority is an approved insurer for the purposes
of the Workers Compensation Act 1958.".
5.2 After section 34 insert--
25 "35. Saving of Government guarantees
Despite the repeal of the State Insurance Office Act
1984 by the Treasury Legislation (Repeal) Act
2005, section 22 of that 1984 Act continues to apply
to a policy, contract or arrangement referred to in that
30 section.".
