Summary Offences Amendment (Body
Piercing) Bill 2007
A Bill for an Act to amend the Summary Offences Act 1966 to create
a new offence dealing with the unauthorised body piercing of a child
and for other purposes.
The Parliament of Victoria enacts:
1. Purpose
The purpose of this Act is to insert a new
Division 6 within Part I of the Summary
Offences Act 1966 to preclude body piercing of a
5 child without appropriate consent of the child's
parent or guardian save in specified
circumstances.
2 Commencement
This Act comes into operation on the day after the
10 day on which it receives the Royal Assent.

Offences Act 1966
After Division 5 of Part I of the Summary
Offences Act 1966 insert--
5 "Division 6--Body Piercing
43 Definitions
In this Division--
body piercing means the piercing of the
human body to create entry and exit
10 holes for the insertion of an object;
child means a person under the age of
18 years.
43A Application
(1) Nothing in this Division applies to body
15 piercing performed in the course of a
procedure carried out in good faith by a
medical practitioner, nurse or Chinese
medicine practitioner registered under the
Health Professions Registration Act 2005.
20 (2) Nothing in this Division affects liability for
an offence against a provision of this or any
other Act or at common law.
44 Body piercing of children
A person must not perform body piercing on
25 a child without the prior written consent of
the child's parent or guardian, given
personally by the parent or guardian to the
person who is to perform the body piercing.
Penalty: 20 penalty units.".

4 Repeal of amending Act
This Act is repealed on the first anniversary of its
commencement.
