PARLIAMENT OF VICTORIA
A BILL
to amend the Road Safety Act 1986 to include "ecstasy" in the
random drug testing program for drivers, to amend the Road Safety
(Drug Driving) Act 2003 to remove the sunset on that program and
for other purposes.
Road Safety (Drugs) Act 2006
The Parliament of Victoria enacts as follows:
1. Purposes
The purposes of this Act are--
(a) to amend the Road Safety Act 1986--
(i) to include "ecstasy" in the random drug
testing program for drivers;

(ii) to repeal section 95A (application of
ACT heavy vehicle charges)
consequent on the repeal of the Road

Transport Charges (Australian Capital
Territory) Act 1993 of the
Commonwealth;
(b) to amend the Road Safety (Drug Driving)
Act 2003 to remove the sunset on the

random drug testing program for drivers.
2. Commencement
(1) This Act (except sections 3, 4 and 5) comes into
operation on the day after the day on which it
receives the Royal Assent.

(2) Sections 4 and 5 come into operation on 1 July
2006.
(3) Subject to sub-section (4), section 3 comes into
operation on a day to be proclaimed.
(4) If section 3 does not come into operation before
15
1 September 2006, it comes into operation on that
day.
3. Random drug testing extended to "ecstasy"
See: After paragraph (a) of the definition of "prescribed

illicit drug" in section 3(1) of the Road Safety
20 127/1986.
Reprint No. 9 Act 1986 insert--
as at
25 August
"(ab) 3, 4-Methylenedioxy-N-Methylamphetamine

4. Registration and permit fees for heavy vehicles
Section 95A of the Road Safety Act 1986 is
repealed.
5. New section 103K inserted
After section 103J of the Road Safety Act 1986

insert--
"103K. Transitional provision--Road Safety
(Drugs) Act 2006
Despite the repeal of section 95A by
section 4 of the Road Safety (Drugs) Act

2006, the prescribed fee in force immediately
before that repeal in respect of any matter
covered by the following paragraphs--
(a) the registration or renewal of
registration of a vehicle referred to in

section 95A(2)(a);
(b) the grant of a permit to operate a
vehicle, or a combination of vehicles,
referred to in section 95A(2)(c)--
continues in force in respect of that matter

until the commencement of regulations made
on or after the commencement of that
section 4 prescribing an amount as a fee in
respect of that matter.".
