Port Services Amendment (Disposal of
Material) Bill 2008
A Bill for an Act to amend the Port Services Act 1995 and for other
purposes.
The Parliament of Victoria enacts:
1 Purpose
The purpose of this Act is to amend the Port
Services Act 1995 to prohibit the placement or
disposal of certain excavated or dredged material
5 in port of Melbourne waters or in the port waters
of the Victorian Regional Channels Authority.
2 Commencement
This Act comes into operation on the day after the
day on which it receives the Royal Assent.

as at "(2) Despite subsection (1)(d), excavated or

of the waters in which it is placed or
disposed of.
20 (3) Before excavated or dredged material is
placed or disposed of in port of Melbourne
waters, the Port of Melbourne Corporation
must carry out those tests that are reasonably
necessary to determine whether or not the
25 placement or disposal of the material in the
waters would contravene subsection (2).".
4 Dredging by VRCA
At the end of section 22 of the Port Services Act
1995 insert--
30 "(2) Despite subsection (1)(d), excavated or
dredged material must not be placed or
disposed of in the port waters of VRCA if
the excavated or dredged material is--
(a) noxious or poisonous; or

(b) harmful or potentially harmful to the
health, welfare, safety or property of
human beings; or
(c) poisonous or harmful or potentially
5 harmful to animals, birds, wildlife, fish
or other aquatic life; or
(d) poisonous or harmful or potentially
harmful to plants or other vegetation; or
(e) detrimental to any beneficial use made
10 of the waters in which it is placed or
disposed of.
(3) Before excavated or dredged material is
placed or disposed of in port waters, VRCA
must carry out those tests that are reasonably
15 necessary to determine whether or not the
placement or disposal of the material in the
waters would contravene subsection (2).".
