Port Services Amendment (Public
Disclosure) Bill 2008
A Bill for an Act to amend the Port Services Act 1995 and for other
purposes.
The Parliament of Victoria enacts:
1 Purpose
The purpose of this Act is to amend the Port
Services Act 1995 to require the Port of
Melbourne Corporation to undertake the
5 immediate public disclosure of environmental
monitoring of the Channel Deepening Project and
for other purposes.
2 Commencement
This Act comes into operation on the day after the
10 day on which it receives the Royal Assent.

3 Principal Act
In this Act, the Port Services Act 1995 is called
the Principal Act.
4 Definitions
5 In section 3 of the Principal Act insert the
following definition--
"Channel Deepening Project means for the
purposes of this Act the project for the
deepening of channels providing shipping
10 access to the port of Melbourne".
5 New section 14B inserted
After section 14A of the Principal Act insert--
"14B Port of Melbourne Corporation Public
Disclosure
15 (1) The Port of Melbourne Corporation must
cause to be published on the Port of
Melbourne Corporation website on the
Internet and presented before each House of
Parliament--
20 (a) every review or revision of any
environment management plan
prepared by the Port of Melbourne
Corporation under Part 6A of this Act;
(b) every report prepared by an auditor
25 under section 91F regarding the
adequacy of an environment
management plan or compliance with
such a plan;
(c) any directions the Port of Melbourne
30 Corporation receives from the Minister
in relation to the Channel Deepening
project; and

(d) any statement or report prepared under
any Act or regulations or prepared by
or for any Minister or public authority
relating to the Channel Deepening
5 Project and its environmental effects
that is received by the Port of
Melbourne Corporation,
immediately on receipt by the Port of
Melbourne Corporation.
10 (2) Where any Minister or public authority
prepares or receives a report, statement or
advice relating to the Channel Deepening
Project and the environmental effects of
such dredging a copy must be delivered
15 immediately to the Corporation, and
published under the provisions of
section 14B(1).
(3) The Port of Melbourne Corporation,
Ministers and public authorities must comply
20 with this section despite any other provision
of this Act or any other Act or any
regulations, directions or guidelines made,
given or issued under this or any other Act.".
6 New sections 91J and 91K inserted
25 After section 91I of the Principal Act insert--
"91J Public disclosure of monitoring results
relating to the Port of Melbourne
Corporation
The Port of Melbourne Corporation must
30 ensure that any data received or obtained by
it as a result of monitoring activities under an
environment management plan is--
(a) published on the Internet immediately
on receipt by the Port of Melbourne
35 Corporation or its delegate; and

(b) available in paper copy within 1 day of
receipt by the Port of Melbourne
Corporation or its delegate.
91K Public disclosure of additional
5 information by Port of Melbourne
Corporation
The Port of Melbourne Corporation must
ensure that any--
(a) response levels; or
10 (b) environmental limits; or
(c) contingency plans--
outlined in an environmental management
plan under Part 6A are published on the
Internet, adjacent to relevant information
15 disclosed under section 91J, immediately
upon final approval of the environment
management plan.".
7 Repeal of Act
This Act is repealed on the first anniversary of its
20 commencement.
