Amendment Bill 2007
A Bill for an Act to amend the Prahran Mechanics' Institute Act
1899 and for other purposes.
Preamble
The Prahran Mechanics' Institute Act 1899
provided for the incorporation of the Prahran
Mechanics' Institution and Circulating Library
(the incorporated body) and for the establishment
of a governing committee.
The Prahran Mechanics' Institute Act 1899 also
vested land in the incorporated body.
The Prahran Mechanics' Institute Act 1912
authorised the incorporated body to borrow money
for the purpose of purchasing land and erecting a
building to extend the Mechanics' Institution and
Circulating Library.
The incorporated body purchased land at High
Street, Prahran for that purpose.

It is expedient to amend the Prahran Mechanics'
Institute Act 1899 to clarify the power of the
incorporated body to purchase the High Street land
and the power of the incorporated body to grant
leases, licences and permits in relation to any land
held by or vested in it or any building on that land.
The Parliament of Victoria therefore enacts:
1 Purpose
See: The purpose of this Act is to amend the Prahran
Act No.
1617 Mechanics' Institute Act 1899--
and
amending (a) to clarify the power of the Prahran
Act Nos
5 10071 and
Mechanics' Institution and Circulating
4/2006. Library to purchase certain land at High

Mechanics' Institution and Circulating
10 Library to grant leases, licences and permits
in relation to any land held by or vested in it
or any building on that land.
2 Commencement
This Act comes into operation on the day after the
15 day on which it receives the Royal Assent.
3 Institute may grant leases, licences and permits in
relation to property
In section 2 of the Prahran Mechanics' Institute
Act 1899 after "whatsoever" insert "and of
20 granting leases of any lands held by or vested in it
or any buildings on those lands, and of granting
licences and permits for the use of those lands and
buildings".

4 Grant of leases, licences and permits
At the end of section 11 of the Prahran
Mechanics' Institute Act 1899 insert--
"(2) Without limiting subsection (1), the said
5 incorporated body may, for the purposes of
the Prahran Mechanics' Institution and
Circulating Library--
(a) grant leases of any lands held by or
vested in the said incorporated body or
10 any part of those lands or any building
standing or being upon those lands; and
(b) grant licences or permits for the use of
those lands and buildings.".
5 New section 17 inserted
15 After section 16 of the Prahran Mechanics'
Institute Act 1899 insert--
"17 Ownership of High Street property
To avoid doubt, it is declared that the said
incorporated body had the power to purchase
20 the land described in folio of the Register
volume 3699 folio 623 (the High Street
property) at the time that the said
incorporated body purchased that land.".
6 Repeal of Act
25 This Act is repealed on the first anniversary of its
commencement.
