A BILL
to revoke the permanent reservations over certain land at North
Melbourne, to repeal Act No. 973 and for other purposes.
North Melbourne Lands Act 1996
Preamble
In 1881, certain land at North Melbourne was
permanently reserved for municipal purposes by
Order in Council dated 17 October 1881 (the
"1881 land").
In 1886, Act No. 906 (now repealed) provided for
the exchange of part of the 1881 land for further
land (the "1886 land"). That Act then permanently
reserved for municipal purposes the 1886 land and
vested the remainder of the 1881 land and the 1886
land, being the land described in items 1 and 2 in
the Schedule to this Act, in the Crown.
In 1888, the land described in items 1 and 2 in the
Schedule to this Act was vested in the City of
North Melbourne (now the City of Melbourne) by
virtue of Act No. 973.

Act No.
To facilitate the sale of the land which is no longer
required for the purposes for which it was
reserved, it is desirable to revoke the permanent
reservations and to repeal Act No. 973.
The Parliament of Victoria therefore enacts as follows:
1. Purposes
The purposes of this Act are--
(a) to revoke the permanent reservations in
respect of certain land at North Melbourne;
and

(b) to repeal Act No. 973; and
(c) to make provision for related matters.
2. Commencement
This Act comes into operation on the day on
which it receives the Royal Assent.

3. Revocation of permanent reservations
(1) The Order in Council specified in item 1 of the
Schedule is revoked.
(2) The land specified in item 2 of the Schedule being
the land described in the Second Schedule to Act
15
No. 906 ceases to be subject to the reservation
imposed by section 4 of that Act.
(3) This section has effect despite anything to the
contrary in any Act, law or instrument.
4. Repeal of Act

Act No. 973 is repealed.

5. Consequences of revoking reservations and repeal of
Act No. 973
On the commencement of this Act--
(a) the land specified in items 1 and 2 of the
Schedule is divested from the City of

Melbourne; and
(b) the land specified in items 1 and 2 of the
Schedule is deemed to be unalienated land of
the Crown, freed and discharged from all
trusts, limitations, reservations, restrictions,

encumbrances, estates and interests; and
(c) the appointment of any committee of
management of the land specified in items 1
and 2 of the Schedule is revoked to the
extent that it relates to that land; and

(d) any regulations under section 13 of the
Crown Land (Reserves) Act 1978 are
revoked to the extent that they apply to the
land specified in items 1 and 2 of the
Schedule.

6. Registrar-General and Registrar of Titles to make
necessary amendments
(1) The Registrar-General must make all entries on
the records of enrolment of any Crown grant and
on any memorial relating to land that are

necessary because of the operation of any
provision of this Act.
(2) The Registrar of Titles must make any
amendments to the Register under the Transfer of
Land Act 1958 that are necessary because of the

operation of any provision of this Act.
