PARLIAMENT OF VICTORIA
A BILL
to provide for the revocation of reservations over certain areas of land,
to repeal the Bendigo (Dai Gum San Village) Land Act 1975 and for
other purposes.
Land (Further Revocation of
Reservations) Act 1998
The Parliament of Victoria enacts as follows:
PART 1--PRELIMINARY
1. Purposes
The main purposes of this Act are--
(a) to revoke reservations over various parcels
5 of land; and

(b) to repeal the Bendigo (Dai Gum San
Village) Land Act 1975.
2. Commencement
(1) This Act (except Part 3 and Schedule 4) comes
5 into operation on the day on which it receives the
Royal Assent.
(2) Subject to sub-section (3), Part 3 and Schedule 4
come into operation on a day to be proclaimed.
(3) If Part 3 and Schedule 4 do not come into
10 operation before 1 July 1999, they come into
operation on that day.

PART 2--REVOCATION OF RESERVATIONS
3. Revocation of reservation and Crown grant--
Kangaroo Flat land
(1) The Order in Council specified in item 1 of
5 Schedule 1 is revoked to the extent that it applies
to the land shown hatched on the plan in
Schedule 2.
(2) Crown grant Volume 2614 Folio 760 is revoked to
the extent that it applies to the land shown hatched
10 on the plan in Schedule 2.
4. Revocation of reservation--Carlton land
The Order in Council specified in item 2 of
Schedule 1 is revoked.
5. Revocation of reservation--Allendale land
15 The Order in Council specified in item 3 of
Schedule 1 is revoked.
6. Revocation of reservation and Crown grant--South
Yarra land (Fawkner Park)
(1) The Order in Council specified in item 4 of
20 Schedule 1 is revoked.
(2) Crown grant Volume 600 Folio 904 is revoked to
the extent that it applies to the land shown hatched
on the plan in Schedule 3.
7. Consequences of revoking reservations
25 On the revocation under this Part of an Order in
Council reserving land--
(a) that land is deemed to be unalienated land of
the Crown, freed and discharged from all
trusts, limitations, reservations, restrictions,
30 encumbrances, estates and interests; and

(b) the appointment of any committee of
management of that land is revoked to the
extent that it relates to that land; and
(c) any regulations under section 13 of the
5 Crown Land (Reserves) Act 1978 are
revoked to the extent that they apply to that
land.

PART 3--FAIRFIELD LAND
8. Operation of Part
This Part has effect despite anything to the
contrary in the Crown Land (Reserves) Act
5 1978, the Land Revocations (And Other
Matters) Act 1995 or any other Act, law or
instrument.
9. Revocation of reservation--Fairfield land
On the commencement of this Part, the land
10 specified in item 5 of Schedule 1 ceases to be
subject to the reservation imposed by section 13
of the Land Revocations (And Other Matters)
Act 1995.
10. Consequences of revocation
15 On the commencement of this Part--
(a) the land specified in item 5 of Schedule 1 is
deemed to be unalienated land of the Crown,
freed and discharged from all trusts,
limitations, reservations, restrictions,
20 encumbrances, estates and interests; and
(b) the Secretary to the Department of Human
Services ceases to be the committee of
management of that land; and
(c) any regulations under section 13 of the
25 Crown Land (Reserves) Act 1978 are
revoked to the extent that they apply to that
land.

PART 4--BENDIGO LAND
11. Revocation of reservation--Bendigo land
On the commencement of this Part, the land
specified in item 6 of Schedule 1, being the land
5 described in the Schedule to the Bendigo (Dai
Gum San Village) Land Act 1975, ceases to be
subject to the reservation imposed by section 2 of
that Act.
12. Repeal of Bendigo (Dai Gum San Village) Land Act
10 1975
The Bendigo (Dai Gum San Village) Land Act
1975 is repealed.
13. Effect of revocation of reservation
On the commencement of this Part--
15 (a) the land specified in item 6 of Schedule 1 is
deemed to be unalienated land of the Crown,
freed and discharged from all trusts,
limitations, reservations, restrictions,
encumbrances, estates and interests; and
20 (b) the appointment of any committee of
management of that land is revoked to the
extent that it relates to that land; and
(c) any regulations under section 13 of the
Crown Land (Reserves) Act 1978 are
25 revoked to the extent that they apply to that
land.

Act No.
PART 5--GENERAL
14. Registrar of Titles and Registrar-General to make
necessary amendments
(1) The Registrar of Titles must make any
5 amendments to the Register under the Transfer of
Land Act 1958 that are necessary because of the
operation of any provision of this Act.
(2) The Registrar-General must make all entries on
the records of enrolment of any Crown grant and
10 on any memorial relating to land that are
necessary because of the operation of any
provision of this Act.
