Land (Revocation of Reservations) Bill
2007
A Bill for an Act to provide for the revocation of reservations of
various parcels of land, revoke related Crown grants in relation to two
of those parcels and for other purposes.
The Parliament of Victoria enacts:
1 Purposes
The purposes of this Act are--
(a) to revoke the permanent reservation of the
bed and banks of Lake Condah for the
5 purposes of transferring that land to the
Gunditjmara people;
(b) to revoke the permanent reservation and
related Crown grant of the Roman Catholic
Orphan Asylum at South Melbourne;

(c) to revoke a reservation for asylum purposes
of land at Daylesford to facilitate the sale of
the land;
(d) to revoke a reservation for benevolent
5 asylum purposes of land at Beechworth and
the related Crown grant to facilitate the sale
of surplus land;
(e) to provide for related matters.
2 Commencement
10 This Act comes into operation on the day after the
day on which it receives the Royal Assent.
3 Revocation of reservation--Lake Condah land
The Order in Council specified in item 1 of
Schedule 1 is revoked to the extent that it applies
15 to the land shown hatched on the plan in
Schedule 2.
4 Revocation of reservation and Crown grant--
Orphan Asylum at South Melbourne
(1) The Order in Council specified in item 2 of
20 Schedule 1 is revoked to the extent that it applies
to the land shown hatched on the plan in
Schedule 3.
(2) Crown grant Volume 2139 Folio 771 is revoked to
the extent that it applies to the land shown hatched
25 on the plan in Schedule 3.
(3) The Roman Catholic Trusts Corporation for the
Diocese of Melbourne ceases to be a trustee of the
land shown hatched on the plan in Schedule 3.

5 Revocation of reservation--Daylesford land
The Order in Council specified in item 3 of
Schedule 1 is revoked to the extent that it applies
to the land shown hatched on the plan in
5 Schedule 4.
6 Revocation of reservation--Former Beechworth
Hospital land
(1) The Order in Council specified in item 4 of
Schedule 1 is revoked to the extent that it applies
10 to the land shown hatched on the plan in
Schedule 5.
(2) Crown grant Volume 244 Folio 652 is revoked to
the extent that it applies to the land shown hatched
on the plan in Schedule 5.
15 7 Consequences of revoking reservations
On the revocation of an Order in Council
reserving land--
(a) that land is deemed to be unalienated land of
the Crown, freed and discharged from all
20 trusts, limitations, reservations, restrictions,
encumbrances, estates and interests; and
(b) the appointment of any committee of
management of that land is revoked to the
extent that it relates to that land; and
25 (c) any regulations under section 13 of the
Crown Land (Reserves) Act 1978 are
revoked to the extent that they apply to that
land.

8 Registrar of Titles to make necessary amendments
The Registrar of Titles must make any recordings
in or amendments to the Register under the
Transfer of Land Act 1958 that are necessary
5 because of the operation of any provision of this
Act.

Situation and area of land: Parish of Condah and Dunmore,
County of Normanby, 244 hectares,
being the bed and banks of Lake
Condah.
Instrument and date of reservation: Order in Council dated 23 May
1881.
Description of land by reference to Government Gazettes dated
Government Gazette: 11 February 1881, page 484 and
27 May 1881, page 1389.
Purpose of reservation: Site for Public Purposes.
Extent of revocation: The land shown hatched on the plan
in Schedule 2.
Item 2--Orphan Asylum, Cecil Street South Melbourne
Situation and area of land: City of South Melbourne, Parish of
Melbourne South, 8122 square
metres, being Allotment 2,
Section 34.
Instrument and date of reservation: Order in Council dated 28 May
1889.
Description of land by reference to Government Gazettes dated
Government Gazette: 12 October 1888, page 3117 and
31 May 1889, page 1794.
Particulars of Crown Grant: Crown Grant Volume 2139
Folio 771.
Purpose of reservation: Site for a Roman Catholic Orphan
Asylum.
Extent of revocation: The land shown hatched on the plan
in Schedule 3.

1887.

Government Gazette: 30 September 1887, page 2847 and
28 October 1887, page 3151.
Purpose of reservation: Site for an Asylum.
Extent of revocation: The land shown hatched on the plan
in Schedule 4.
Item 4--Former Beechworth Hospital land
Situation and area of land: Township of Beechworth, Parish of
Beechworth, County of Bogong,
1·745 hectares, being Allotments 1,
2 and 3, Section C2.
Instrument and date of reservation: Order in Council dated
20 November 1865.
Description of land by reference to Government Gazette dated
