PARLIAMENT OF VICTORIA
A BILL
to dismiss the Nillumbik Shire Council and set a date for a general
election for that Council and for other purposes.
Local Government (Nillumbik Shire
Council) Act 1998
The Parliament of Victoria enacts as follows:
1. Purpose
The purpose of this Act is--
(a) to dismiss the Nillumbik Shire Council; and
(b) to provide for the expiry of the Order in
5 Council that applies to that Council; and
(c) to set a date for a general election of the
Nillumbik Shire Council.

2. Commencement
This Act comes into operation on the day on
which it receives the Royal Assent.
3. Construction of Act
5 This Act must be read and construed as if it was
part of the Local Government Act 1989.
4. Definition
In this Act--
"Order in Council" means the Order in Council
10 made by the Governor in Council in relation
to the Nillumbik Shire Council under section
219 that was published in the Government
Gazette (No. S 112) on 13 October 1998, and
includes any subsequent Order in Council
15 that is made under section 219(2)(c) or (d).
5. Dismissal of Council
(1) The Nillumbik Shire Council is dismissed.
(2) The persons holding office as councillors of the
Nillumbik Shire Council cease to hold office.
20 (3) Nothing in this Act affects the continuity of the
Nillumbik Shire Council as constituted under
section 219(3) by the administrator appointed
under the Order in Council.
6. General election
25 (1) A general election for the Nillumbik Shire
Council is to be held on 20 March 1999.
(2) The Chief Executive Officer must summon a
meeting of the Council within 14 days after the
day the returning officer for the election publicly
30 declares the result of the election.

(3) Despite anything to the contrary in section 219(7),
the Order in Council expires when that meeting of
the Council starts.
(4) Sections 219(9) to 219(12) do not apply in respect
5 of the expiry of the Order in Council.
(5) Section 36(2) applies as if the general election
held under sub-section (1) of this section was a
general election held under section 36(1).
