PARLIAMENT OF VICTORIA
A BILL
to dismiss the Darebin City Council and set a date for a general
election for that Council and for other purposes.
Local Government (Darebin City
Council) Act 1998
The Parliament of Victoria enacts as follows:
1. Purpose
The purpose of this Act is--
(a) to dismiss the Darebin City Council; and
(b) to extend the operation of the Order in
5 Council that applies to that Council; and
(c) to set a date for a general election of the
Darebin City Council.

2. Commencement
This Act comes into operation on the day on
which it receives the Royal Assent.
3. Construction of Act
5 This Act must be read and construed as if it was
part of the Local Government Act 1989.
4. Definition
In this Act--
"the Order in Council" means the Order in
10 Council made by the Governor in Council in
relation to the Darebin City Council under
section 219 that was published in the
Government Gazette on 13 June 1997, and
includes any subsequent Order in Council
15 that is made under section 219(2)(c) or (d).
5. Dismissal of Council
(1) The Darebin City Council is dismissed.
(2) The people holding office as councillors of the
Darebin City Council cease to hold office.
20 (3) Nothing in this Act affects the continuity of the
Darebin City Council as constituted under section
219(3) by the administrator appointed under the
Order in Council.
6. Extension of Order in Council
25 Despite anything to the contrary in section 219(7),
the Order in Council continues in force until it
expires under section 7 of this Act.

7. General election
(1) A general election for the Darebin City Council is
to be held on 12 September 1998.
(2) The Chief Executive Officer must summon a
5 meeting of the Council within 14 days after the
day the returning officer for the election publicly
declares the result of the election.
(3) The Order in Council expires when that meeting
of the Council starts.
10 8. Future elections
(1) The next general election for the Darebin City
Council after the election required by section 7(1)
of this Act is to be held on 16 March 2002.
(2) Section 36(2) applies after that date to the Darebin
15 City Council as if a general election held under
sub-section (1) was a general election held under
section 36(1).
