PARLIAMENT OF VICTORIA
A BILL
to amend the Education Act 1958 to make further provision
relating to State schools and for other purposes.
Education (State Schools) Act 1997
The Parliament of Victoria enacts as follows:
1. Purpose
The main purpose of this Act is to amend the
Education Act 1958 to make further provision
relating to State schools.
5 2. Commencement
This Act comes into operation on the day on
which it receives the Royal Assent.

"25C. Regulations about age requirements for
March 1995
and further
enrolment etc at State schools
amended by
Nos 104/1995,
5 (1) The head teacher or principal of a State
44/1996,
school may refuse--
47/1996,
59/1996,
3/1997 and (a) to enrol a person at that school or in a
20/1997.
program or course of study offered,
conducted or provided by that school or
10 to allow a person to continue to be so
enrolled; or
(b) to allow a person to attend that school
or to attend or participate in any
program or course of study offered by
15 that school or to allow a person to
continue to so attend or participate--
if the person is under, of or over an age
specified in the regulations in relation to
enrolment or attendance at a State school or
20 enrolment, attendance at or participation in
any program or course of study offered,
conducted or provided by a State school.
(2) The regulations may make provision for or
with respect to--
25 (a) age requirements for persons to enrol at
or attend a State school or to enrol in,
attend or participate in any program or
course of study offered, conducted or
provided by a State school or for such
30 persons to continue to be so enrolled or
to so attend or participate; and
(b) prohibiting or regulating that
enrolment, attendance or participation
or the continuation of that enrolment,

attendance or participation on the basis
of those age requirements.".
4. New section 85 inserted
After section 84 of the Education Act 1958
5 insert--
"85. Non-application of certain provisions
Nothing in the amendments to this Act made
by the Education (State Schools) Act 1997
or in regulations made under section 25C
10 affects the rights or obligations of the parties
in the proceeding known as Stuart Bacon
and ors v State of Victoria (Department of
Education) (Number 6991 of 1997) in the
Supreme Court of Victoria.".
